Atkinson Sentenced to Eight Years for US Fidelis Auto Warranty Fraud

Darain Atkinson's state sentence will run concurrently with his federal sentence of eight years.

The co-founder of the former Wentzville-based U.S. Fidelis auto warranty company, Darain Atkinson, was sentenced Monday for the second time in two weeks. On Monday, the St. Louis Post-Dispatch reported Atkinson's sentencing in St. Charles Circuit Court on state charges for Atkinson's part in the U.S. Fidelis/National Auto Warranty Services fraud case. Last week, Atkinson received an eight-year sentence on federal charges, along with an order to pay $4.5 million in back taxes. Darain Atksinson's brother Cory Atkinson was sentenced to 40 months in federal prison and $4.49 million in back taxes, along with a four-year sentence for state charges. Atkinson Sentenced to 40 Months and $4 Million Restitution in US Fidelis Tax Fraud Case

Cory Atkinson co-owned U.S. Fidelis, at one time the nation's largest marketer of vehicle service contracts.

Cory Atkinson, co-owner of former Wentzville business US Fidelis, received a 40-month prison sentence and was ordered to pay $4 million in restitution to the IRS for his part in a massive tax fraud case. According to a press release from the Department of Justice, Atkinson and his brother Darain Atkinson were co-owners of U.S. Fidelis, at one time the nation’s largest marketer of vehicle service contracts (VSCs). In June, Cory Atkinson pleaded guilty to one count of conspiracy to commit mail and wire fraud and one count of filing false tax returns. More Guilty Pleas in Atkinson-US Fidelis Case

Cory Atkinson may spend less than four years in prison for his part in the US Fidelis fiasco.

Fox2 News reported Monday that Cory Atkinson, co-owner of the US Fidelis auto-service contract company formerly located in the old Belz Factory Mall building in Wentzville, pleaded guilty to federal charges. The charges included conspiracy to commit mail and wire fraud and filing false tax returns. This is in addition to his guilty pleas last Thursday to state charges of fraud and stealing. Atkinson may spend less than four years in prison, The Post-Dispatch reported Monday, if the US District Court judge agrees to a plea agreement that would drop one charge of tax evasion. Atkinson Pleads Guilty to Federal Charges in US Fidelis Case

Sentencing is scheduled for July 12.

In a press release today, the US Department of Justice reported that Darain Atkinson had pled guilty to conspiracy to commit mail and wire fraud and filing false tax returns. Together with his brother Cory Atkinson (who is still presumed innocent until proven guilty), Darain Atkinson owned and operated several businesses: National Auto Warranty Services (NAWS), US Fidelis and Dealer Services and a direct mail service, DS Direct. The Department of Justice reported that: The primary business of NAWS was marketing and selling vehicle service contracts (VSCs) through the United States. . .
